New advice on NOMS Sickness Policy

Napo’s continued pressure on NOMS over the discriminatory aspects of the new Absence Management Policy has finally produced progress with the publication of a ‘suitable and sufficient’ (EA) Equality Analysis of the procedure.  This will be helpful as it introduces measures to take account of the requirement to comply with the Public Sector Equality Duty (PSED), stating that decision makers and managers should, among other things:

  • exercise discretion around warnings/sanctions in appropriate circumstances
  • act fairly and reasonably, considering each case on its own facts and merits
  • Obtain appropriate occupational health advice
  • receive appropriate training on diversity issues
